Do you charge a fee for a consultation?
Sometimes. Business disputes and civil litigation cases require a modest consultation fee. However, for most personal injury cases and collection cases, there is no charge for an initial attorney consultation and case evaluation. In either situation, you are under no obligation to use our firm to represent you.
How will I pay attorney fees?
Our attorneys represent personal injury accident clients on a contingency fee basis, which means a percentage of the recovery is used to cover the fee for your personal injury or other similar claim.
When should I settle my case?
It would be premature to discuss a settlement until the nature and extent of your injuries, or conflict, are fully known. A settlement typically resolves a case quicker than going to trial. Your case must be thoroughly reviewed to determine if a settlement is in your best interests.
Do most cases need to go to trial to recover damages?
We prepare each case expecting it to go to trial, but most cases we handle rarely go to trial. However, the majority of legal cases are either settled through mediation or by agreement without going to trial
What are the factors affecting whether monetary damages can be recovered?
Personal Injury cases address four main issues:
- Liability - was a third party negligent in any way?
- Causation - did the negligent conduct cause an injury?
- Damages - what is the amount that will fairly and adequately compensate you for your injuries
- Source of collection - is there insurance or other assets from which monetary damages can be recovered?
What is a normal settlement amount for personal injuries?
Every legal case is different. There is no standard measure of compensation. However, there are various factors which will be considered when negotiating a fair settlement. The monetary value of a legal claim is determined when we review and interpret the case information, such as:
- The strength and weakness of liability and causation from the evidence and witnesses
- The total amount of medical bills incurred from the personal injury
- The amount of medical bills that may be incurred in the future
- Loss of past income or loss of employment
- Loss of future earning capacity and working ability
- Extent of the injuries sustained, and how they have affected you and your family in the past
- How your injuries will likely affect you and your family in the future
- Precedents set by other similar cases
